Terms and Conditions of Mooring Licence

1. Payment of Fees: Mooring fees must be paid no later than the day before the start of the new licence.

2. Late Payment: A late payment/administration fee of £30 will be charged after 7 days, plus £30 collection fee per month.

3. Overnighting: Overnight stays are not permitted on this mooring.

4. Liability: Lazy Days Marina accepts no responsibility, howsoever caused, for loss, damage, or personal injury. Use of the mooring, pontoons, jetties, and slipway, including access, is the sole responsibility of boat owners and their guests.

5. Non-Transferable Licence: This licence is personal to the Owner and relates to the Vessel described. It is not transferable, cannot be sold, or inherited. If the Vessel is sold it must be removed immediately, unless otherwise agreed in writing.

6. Notification of Changes: The Owner must notify the Company in writing within 7 days of any change of vessel name, Owner’s contact details, address, or email.

7. Berth Allocation: The Company retains absolute control of berth allocation. Owners are not entitled to exclusive use of any berth and must use the berth allocated by the Company.

8. Absence: If the berth is to be unoccupied for more than 7 days, the Owner must inform the Company. No refund or payment will be made in such circumstances.

9. Termination for Breach: The Company may terminate this licence in the event of any breach. No refund will be payable for any suspended or remaining period.

10. Removal of Vessel on Termination: If the Owner fails to remove the Vessel after termination, the Company may charge £50 per day until removal.

11. Maritime Law: The Company may, under Maritime Law, bring action against a Vessel to recover debt or damages.

12. Right to Move Vessels: The Company reserves the right to move any Vessel, gear, equipment, or goods at any time for reasons of safety, security, or good management.

13. Mooring Standards: Vessels must be berthed or moored as directed by the Company. Adequate warps and fenders must always be provided by the Owner.

14. Parking: Owners are not guaranteed a parking space. Lazy Days Marina provides a small car park with capacity for up to four vehicles. To ensure fair use, parking is limited to one car per boat. On occasions when spaces are not available, additional parking can be found nearby on Barge Lane and at the bottom of Firestone Copse. The car park may occasionally be unavailable (for example, during maintenance or events). Parking is permitted only in the clearly marked: “Customer Parking Bay”. The HOUSE YARD and the LANE are strictly prohibited for parking and must remain CLEAR AT ALL TIMES for safety, practical, and access reasons.

15. Refuse: No refuse may be thrown overboard or left on pontoons, car parks, bins, or any other part of the Premises.

16. Fuel Storage:
For health and safety reasons, no portable fuel tanks, jerry cans, or other fuel containers are to be stored or left anywhere on the premises of Lazy Days Marina, including pontoons, car parks, or yard areas.
Fuel containers may only be kept on board vessels if stored safely in appropriate lockers designed for that purpose (i.e. upright, vented to the open air, self-draining, and protected from ignition sources).
Storing fuel inside cabins, engine spaces, or in any non-compliant manner is strictly prohibited

17. Dogs: Well-behaved dogs are welcome but must be kept under control and on a lead when on the premises, including pontoons. Owners are expected to be responsible and conscientious.

18. No Refunds: All payments to the Company are non-refundable under any circumstances , including if the licence ends early, the vessel is sold, or removed from the Marina.

19. Conduct and Behaviour: The Company is committed to a safe, respectful, and welcoming environment. The Company may terminate this licence, without refund, if the behaviour of the Owner or their guests is, in the reasonable opinion of the Company, disrespectful, abusive, or causes disruption or distress to the Company, its staff, or other customers.

20. Insurance: All vessels must carry adequate third-party liability insurance while berthed or moored at the Marina. A copy of the current certificate must be provided to the Company on request.

21. Compliance with Law: Owners and guests must comply with all applicable laws, regulations, and harbour authority rules while using the Marina.

22. Termination for Non-Payment: Failure to pay fees when due entitles the Company to terminate this licence with immediate effect and remove the vessel from the berth and/or Marina at the Owner’s expense.

23. Notices: Any notice from the Company will be deemed properly served if sent by email or recorded delivery to the last known address or email address of the Owner. Notices are deemed served 48 hours after posting, or immediately upon successful sending of an email.

24. Estate and Probate Matters: In the event of the death of a vessel owner, the Owner’s representative, executor, or solicitor must notify the Company as soon as reasonably possible. Where an executor or solicitor has already been appointed, their details should kindly be provided to the Company for correspondence at the signing of this contract.
